Terms and Conditions for Foodception.com Pricing Plans

These Terms and Conditions outline the agreement between Foodception.com ("we," "our," "us") and users ("you," "your," "member") who subscribe to our Free or Pro Membership plans. By signing up for any Foodception membership, you agree to these terms. Please read them carefully.

1. Membership Plans

Foodception offers two membership options:

a. Free Membership

Access: All public recipes on the website.
Favorites Limit: You may save up to 50 favorite recipes.
Ads: The Free Membership includes advertisements.
AI Tools and Recipe Generation: Not included.
Content: Access to general content without additional AI features.

b. Pro Membership

Access: All public recipes on the website.
Favorites Limit: Save up to 250 recipes or other favorite content.
Ads: Ad-free browsing experience.
AI Tools and Recipe Generation: Access to weekly recipe suggestions generated by AI.
Special Badge: Display of a "Pro Member" badge on your profile.

2. Subscription Details

a. Subscription Term

Both Free and Pro Memberships are valid until canceled by the user.
Pro Membership includes a 14-day free trial for new subscribers. You may cancel within this trial period without any charge.

b. Billing and Payments (Pro Membership Only)

Recurring Payments: Pro Membership fees are billed on a monthly or annual basis, depending on your choice at signup.
Automatic Renewal: Your membership will automatically renew at the end of each billing period unless canceled before the renewal date.
Payment Method: You authorize Foodception to charge your selected payment method on file for recurring subscription fees.
Failed Payments: If a payment fails, you will be notified and may lose access to Pro features until payment is resolved.
Currency and Taxes: All prices are listed in USD. You are responsible for any applicable taxes.

c. Cancellation and Refund Policy

Cancellation: You may cancel your subscription at any time via your account settings. Canceling your Pro Membership stops future billing but does not retroactively refund previous payments.
Refunds: Refunds are not issued for partial billing periods. If you cancel during your free trial, you will not be charged.
Trial Period: New users may try Pro Membership free for 14 days. Cancel within the trial to avoid charges; no refund is needed if canceled within this period.

3. Account Usage

a. Eligibility

To use Foodception membership plans, you must be at least 18 years old or have parental consent.
Only one membership per person or household is allowed.

b. Account Security

You are responsible for maintaining the confidentiality of your login information.
Foodception is not liable for any loss or damage due to unauthorized access resulting from your failure to secure your account.

c. Limitations of Use

Members cannot share their accounts with others. Memberships are intended for individual use only.
Misuse of account privileges may result in suspension or termination without refund.

4. Features and Benefits

a. Recipe Access

Both Free and Pro members have access to all publicly available recipes.
Pro Members receive additional AI-powered recipe suggestions and exclusive tools when available.

b. Favorites

Free Members may save up to 50 recipes; Pro Members may save up to 250 recipes.
Deleting favorites will free up space within the specified limit.

c. AI Tools and Ad-Free Browsing

AI-generated recipe suggestions and an ad-free experience are exclusive to Pro Members.
Foodception reserves the right to modify or discontinue specific Pro features at any time with prior notice.

5. Modifications and Termination

a. Changes to Membership Plans

Foodception may adjust the pricing, features, or terms of any membership plan. Any changes will be communicated to members at least 30 days in advance.
Changes to pricing will not affect existing members within their current billing cycle, but the new rates will apply upon renewal.

b. Termination of Service

Foodception reserves the right to suspend or terminate your membership for any violation of these terms.
In the event of termination due to a violation, no refund will be provided.

6. Intellectual Property and Use of Content

a. Intellectual Property

All content provided on Foodception.com, including recipes, images, and AI-generated content, is protected by copyright and other intellectual property laws.
You may not reproduce, distribute, or create derivative works from the content without prior written permission.

b. User-Generated Content

By submitting content (e.g., reviews, comments), you grant Foodception a non-exclusive, royalty-free license to use, display, and modify your content in connection with the website and its promotional materials.

7. Disclaimer of Warranties and Liability

a. No Guarantees

Foodception does not guarantee the accuracy, completeness, or usefulness of any content on the site.
Recipes and AI-generated suggestions are provided for informational purposes only, and Foodception is not responsible for any outcomes from their use.

b. Limitation of Liability

To the maximum extent permitted by law, Foodception shall not be liable for any damages arising from your use of the website, including direct, indirect, incidental, or consequential damages.

8. Privacy

Your personal information is protected under our Privacy Policy, which describes how we collect, use, and safeguard your information. By subscribing, you agree to the practices described in the Privacy Policy.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Texas, United States.
